Terms of use
1. Who we are
This website, kiaadvisory.com, is operated by PT Nusa Berkat Advisory, trading as KIA Advisory (“KIA Advisory”, “we”, “us”), Wisma Nusa Permai B10, Kampial, Nusa Dua, Kuta Selatan, Badung, Bali 80361, Indonesia. You can contact us at hello@kiaadvisory.com.
2. Acceptance
By using this website you agree to these terms. If you do not agree, please do not use the website.
3. General information only
Content on this website, including our insights and frequently asked questions, is general information about corporate and commercial matters in Indonesia as at the date shown. It is not legal, tax, investment or other professional advice and should not be relied on as such. Laws, regulations and their application change, sometimes quickly, and every situation is different.
Using this website, reading its content or sending us an email does not create an advisor-client relationship. That relationship begins only when we have agreed the scope and terms of an engagement with you in writing. Please do not send us confidential information until we have confirmed that we can act for you.
4. Engagements
Any services we provide are governed by a separate engagement letter or agreement. If there is a conflict between that document and these terms, the engagement document prevails.
5. Intellectual property
Unless stated otherwise, the text, design, logos and images on this website belong to KIA Advisory or are used with permission. You may view, print and share links to our content for your own non-commercial use, provided you do not alter it and you credit KIA Advisory as the source. Any other reproduction requires our written permission. Client names and logos are shown with permission and remain the property of their owners.
If you believe material on this website infringes your rights, email hello@kiaadvisory.com with details of the material and your claim, and we will review it promptly. This website does not accept uploads or content from users.
6. Acceptable use
You must not use this website in a way that is unlawful, that interferes with its operation or security, or that involves automated extraction of content in a way that places an unreasonable load on it. Reasonable crawling by search engines and AI assistants in line with our robots.txt is welcome.
7. Links to other websites
Links to third-party websites, including KIA Consulting Group, are provided for convenience. We are not responsible for the content or privacy practices of those websites.
8. Liability
We take care to keep this website accurate and available, but it is provided “as is”. To the extent permitted by law, we are not liable for any loss arising from reliance on its content or from its unavailability. Nothing in these terms excludes liability that cannot be excluded by law, including under consumer protection laws that apply to you.
9. Changes
We may update these terms from time to time. The date at the top of this page shows when they were last changed.
10. Governing law
These terms are governed by the laws of the Republic of Indonesia. Disputes will be submitted to the District Court of Denpasar, without affecting any mandatory rights you may have to bring proceedings where you live.
Privacy policy
This policy explains how KIA Advisory handles personal data in connection with this website and enquiries sent to us. We aim to meet Indonesia’s Personal Data Protection Law (Law No. 27 of 2022) and, where they apply to you, the EU and UK General Data Protection Regulation, the California Consumer Privacy Act and the Australian Privacy Act.
1. Controller
PT Nusa Berkat Advisory (KIA Advisory), at the address above, is the controller of the personal data described here. Privacy questions and requests can be sent to hello@kiaadvisory.com.
2. What we collect
- Information you send us. When you email us, we receive your name, email address and anything you choose to include, such as details of your business or matter.
- Client information. If you engage us, we process the information needed to carry out the work, including identity and corporate documents. This is also covered by your engagement terms.
- Technical data. Like any website, our hosting server records basic request data (IP address, browser type, page requested, date and time) in its logs for security and to keep the site running.
This website has no sign-up, account, contact form or payment function. We do not use analytics, advertising, social media tracking pixels, session recording or fingerprinting. Fonts and images are served from our own server, so visiting the site does not send your IP address to Google or any other third party.
3. Why we use it and our legal basis
| Purpose | Legal basis |
|---|---|
| Replying to your enquiry and deciding whether we can help | Steps at your request before entering a contract; our legitimate interest in responding to enquiries |
| Providing services to clients | Performance of a contract |
| Keeping records and meeting legal, tax and regulatory duties, including identity checks | Legal obligation |
| Keeping the website secure and working | Legitimate interest |
We do not sell or share personal data for advertising, and we do not use it for automated decision-making or profiling.
4. Who we share it with
- Service providers who host our website and email, acting on our instructions.
- Notaries, government systems (such as OSS), tax advisers, accountants or other professionals, where this is needed for your matter and you have asked us to proceed.
- KIA Consulting Group companies, where you ask us to involve them, for example on immigration matters.
- Authorities, where we are required to do so by law.
5. International transfers
Our service providers may store data outside Indonesia or outside your country. Where that happens, we rely on the safeguards required by applicable law, such as contractual protections, and we only use providers with appropriate security.
6. How long we keep it
Enquiries that do not lead to an engagement are kept for up to 24 months and then deleted. Client files are kept for as long as Indonesian law requires, generally up to 10 years after the matter closes. Server logs are kept by our hosting provider for a short period, normally no more than a few months.
7. Security
The site is served only over encrypted HTTPS. We limit access to personal data to people who need it and take reasonable technical and organisational measures to protect it. If a data breach affects you, we will notify you and the relevant authority as required by law.
8. Your rights
Depending on where you live, you may have the right to:
- know what personal data we hold about you and get a copy of it
- have inaccurate data corrected
- have data deleted, or its use restricted or stopped
- object to processing based on our legitimate interests
- receive your data in a portable format
- withdraw consent at any time, where we rely on consent
- complain to a data protection authority, for example the Indonesian data protection authority, your local supervisory authority in the EU or UK, or the Office of the Australian Information Commissioner
To exercise these rights, email hello@kiaadvisory.com. We will respond within the time required by applicable law and will not treat you differently for exercising your rights. We may need to verify your identity first.
California residents: we do not sell or share personal information as those terms are defined in the CCPA. We honour Global Privacy Control browser signals.
9. Children
This website and our services are intended for businesses and adults. They are not directed at children and we do not knowingly collect personal data from anyone under 18. If you believe a child has sent us personal data, please contact us and we will delete it.
10. Email
We only email you in reply to your enquiry or in connection with work we are doing for you. We do not send marketing newsletters. If we ever do, we will only send them with your permission, and every message will include our postal address and a working unsubscribe link.
11. Changes to this policy
We will update this policy if our practices change and will show the new date at the top of this page.
Cookie policy
This website does not set any cookies. It stores a single item in your browser’s local storage to remember your privacy choice, so that we do not ask you again on every page.
| Name | Type | Purpose | Duration |
|---|---|---|---|
kia_consent | Strictly necessary (local storage, first party) | Records the choice you made in the privacy banner | 12 months, then we ask again |
The banner includes optional “Analytics” and “Marketing” categories. No such tools are in use today. If we add one, it will run only for visitors who have switched the relevant category on, and this policy will be updated first.
You can change your choice at any time: . You can also clear site data in your browser settings. If your browser sends a Global Privacy Control signal, optional categories start switched off.
